1. Introduction

However, we do not warrant that product descriptions, images, or other content on the Site are error-free, complete, or current. Colors may appear differently on different screens. If a product we sell does not match the description, your sole remedy is to return it under our Return Policy.

4.2 Pricing
All prices on the Site are listed in Euros (EUR) and exclude shipping costs unless otherwise stated. Shipping costs are calculated at checkout. Prices are subject to change without notice, but changes will not affect orders already confirmed. We make every effort to ensure accurate pricing. If an obvious pricing error occurs (e.g., a product listed at €1 instead of €100), we reserve the right to cancel the order and refund any amounts paid, even after confirmation.

4.3 Taxes
For orders shipped within the European Union, prices include applicable VAT (Value Added Tax) as required by law. For orders shipped outside the EU, prices are exclusive of VAT, and you are responsible for any import duties, customs fees, or local taxes. See our Shipping Policy for details.

5. Orders and Acceptance

5.1 Placing an Order
When you place an order through our Site, you are making an offer to purchase the products in your cart. We will send you an order confirmation email acknowledging receipt of your order. This confirmation does not constitute acceptance of your order.

5.2 Order Acceptance
Acceptance of your order occurs when we dispatch the products and send you a shipping confirmation email. Until that time, we may reject your order for any reason, including but not limited to: product unavailability, payment authorization issues, pricing errors, or suspected fraud. If we reject your order after payment has been processed, we will issue a full refund.

5.3 Order Cancellation
You may cancel an order before it is shipped by contacting us at buy@homefurnit.com. Once the order has been shipped, you must follow our Return Policy. We reserve the right to cancel any order if we suspect fraudulent activity or violation of these Terms.

By providing payment information, you represent and warrant that you are authorized to use the selected payment method. If your payment fails or is declined, your order will not be processed. We may use fraud detection services to verify payment information.

7. Shipping and Delivery

Shipping terms, delivery estimates, costs, and customs responsibilities are set forth in our Shipping Policy, which is incorporated into these Terms by reference. Delivery dates are estimates only. We are not liable for delays beyond our reasonable control. Title and risk of loss pass to you upon delivery to the carrier. For EU customers, risk passes when you (or a third party you designate) takes physical possession of the products.

8. Returns, Refunds, and Warranty

Your rights to return products, obtain refunds, and warranty coverage are described in our Return Policy, which is incorporated into these Terms by reference. For EU customers, nothing in these Terms limits your statutory rights under the Consumer Rights Directive or local consumer protection laws.

14. Limitation of Liability

To the maximum extent permitted by applicable law, our company, its directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or personal injury, arising out of or relating to your use of the Site or products purchased, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your purchase shall not exceed the amount you paid for the product giving rise to the claim, or €100, whichever is greater.

For EU customers, these limitations do not apply to claims of death, personal injury, fraud, willful misconduct, gross negligence, or any liability that cannot be limited under mandatory consumer protection laws. Nothing in these Terms affects your statutory rights as a consumer.

15. Indemnification

You agree to indemnify, defend, and hold harmless our company and our officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

16. Force Majeure

If you reside in the European Union, these Terms and any dispute arising from them shall be governed by the laws of your country of residence. You may bring claims against us in the courts of your country of residence. We will comply with applicable consumer protection laws, including the EU Online Dispute Resolution (ODR) platform available at ec.europa.eu/odr. We do not participate in alternative dispute resolution procedures before a consumer arbitration board, but we will cooperate with the ODR platform.

17.2 For Non-EU Customers
If you reside outside the European Union, these Terms shall be governed by the laws of the State of Kentucky, United States, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or relating to these Terms shall be instituted exclusively in the federal or state courts located in Fayette County, Kentucky. You waive any objection to jurisdiction or venue in such courts.

17.3 Dispute Resolution Process
Before filing a lawsuit, you agree to contact us at buy@homefurnit.com to attempt to resolve the dispute informally. We will make a good faith effort to resolve the dispute within 30 days.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return Policy, constitute the entire agreement between you and us regarding your use of the Site and purchase of products, superseding any prior agreements or communications.

20. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. For material changes, we will notify you by email or via a prominent notice on the Site. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.
